The Buying Process
For anyone who hasn't bought real estate previously, there are many great resources out there for you in terms of education about the buying process, prior to getting started. Employing a Buyer's Agent / Representative
Employing a Buyer's Agent for your purchase is critical. More and more buyers are going directly to the listing realtor and making their own deal, instead of employing a Buyer's Representative. They seem to feel that they'll be able to get a better deal. They are grossly mis-informed and here's why:
- Sellers sign an Agency agreement with their listing realtors. That binds the listing realtor, by law, to work in the best interest of the seller. How can they then work for the best interests of the Buyer?
- Negotiable commissions? Buyers seem to feel that because the listing realtor doesn't have to "share" the commission with a buyer's agent, there's more room for the listing agent to get the a good deal. The fact is, some listing agents will reduce their commission by a small amount but it doesn't compare to the amount a dedicated, competant Buyer's agent should be able to negotiate for you. Bottom line, you can't get as good a deal as you can with your own agent.
- How can one agent negotiate for 2 opposing parties in the same transaction and act in the best interest of both parties? The answer, they can't. Do yourself a favour and be fully-represented in your purchase. employ a Buyer's Representative!

Standard forms required when buying Vancouver Real Estate
1. Working with a Realtor Pamphlet
- This is an informational pamplet that provides information about the legal Agency relationship between a Realtor and their clients (Buyers and Sellers alike) as well as information concerning the Privacy Act as it relates to your personal information. This form is not a contract, it is a "sign as having read" document.
2. Disclosure of Remuneration
- Prior to you making an offer, your realtor is required to disclose to you, as a BUYER, the total commissions and any other remuneration they expect to receive as a result of your buying any real estate in Vancouver.
3. "The Offer" - Contract Of Purchase and Sale
- This is the most significant document you will run into during the Buying process. It's very straight forward and you Buyer's representative will help you understand it and fully complete it.
4. Subject Removal Form
- If you have any subjects in your offer (Contract of Purchase and Sale), in order to make your offer firm and binding, you'll have to "remove" these subjects. This is done simply by inserting the words, "To remove the following subjects" at the top of an addendum to your contract and reprinting the subjects you wish to remove below.
5. FINTRAC Form
- As of June 2008 this is a new, mandetory form required for the purchase or sale of all real estate in Canada. It has been instituted in an attempt to reduce money laundering and organized crime activity related to real estate. It requires Buyers and Sellers to produce qualifying ID to their agent or mandetory. *Note: Your sale can not proceed without this form being submitted complete.
6. Legal: Conveyance and Mortgage documents
- Your legal representative will handle these documents for you and explain what is needed to complete your purchase.
